This Privacy Policy explains how Motiontelligent (operated by Hive Endeavors, LLC) ("Motiontelligent," "we," "us," or "our") collects, uses, discloses, and safeguards information in connection with the Motiontelligent website, applications, and services (the "Service"). By using the Service, you agree to this Policy. If you do not agree, do not use the Service.

Because the Service is an AI-assisted creative tool, material you submit (including prompts, URLs, uploaded videos and images, and other Inputs) is transmitted to and processed by third-party AI Providers to generate Outputs. Please review Section 5 before submitting any sensitive or personal information.

1.Who We Are; Scope

For the purposes of applicable data-protection laws, the data controller is Hive Endeavors, LLC, located at 3575 Long Beach Blvd, Long Beach, CA 90807. This Policy applies to information processed through the Service. It does not apply to third-party services or sites that have their own privacy policies.

2.Information We Collect

Information you provide

  • Access credentials and profile information: any shared password used to access the Service, and profile names you create. We do not require an email or government identity to use the core local features unless you choose to provide it.
  • Inputs and User Content: prompts, instructions, landing-page URLs, product/brand details, scripts, notes, and uploaded reference videos, images, and audio that you submit.
  • Generated Outputs and media: scripts, ad copy, images, video clips, stitched videos, voiceovers, captions, analyses, and related metadata you create through the Service.
  • Communications: information you provide if you contact us for support or other inquiries.

Information collected automatically

  • Usage and cost data: feature usage and the local cost-tracking ledger (provider, model, estimated cost, timestamps) used to display spend.
  • Device and log data: IP address, browser type, operating system, pages and actions, timestamps, and similar diagnostic data, including via our hosting provider.
  • Cookies and local storage: a first-party authentication cookie, plus browser localStorage and IndexedDB used to store your app state, profiles, generated media, and synchronization data on your device.

Please do not upload special-category or highly sensitive personal data, or personal data of other individuals, unless you have a lawful basis and all required consents. You are responsible for the content you submit.

3.How We Use Information

  • to provide, operate, maintain, secure, and support the Service, including generating Outputs from your Inputs;
  • to store and synchronize your profiles, libraries, and app state across your devices when you use the sync feature;
  • to develop, improve, evaluate, and create new features and models, including through aggregated and de-identified analysis (as further described in our Terms, Section 7.3);
  • to monitor, prevent, detect, and address fraud, abuse, security incidents, and violations of our Terms;
  • to communicate with you about the Service; and
  • to comply with legal obligations and enforce our agreements.

Where required by law, we rely on the following bases for processing: performance of our contract with you; our legitimate interests in operating and improving the Service and securing it; your consent (where applicable); and compliance with legal obligations.

4.Local Storage & Synchronization

Much of your data is stored locally in your browser (localStorage and IndexedDB) and remains on your device until you clear it. If you use synchronization, a snapshot of your app state and your generated media may be stored on our hosting provider's storage so that your work persists and can be accessed on another device using your sync code. Anyone with your sync code may be able to access the associated profile data; keep it confidential.

5.Third-Party Providers & Sub-processors

To operate the Service, we share the information necessary to fulfill your requests with third-party Providers and sub-processors, which may include (without limitation):

  • Vercel — hosting, serverless functions, and media/state storage;
  • Anthropic (Claude) — text generation and analysis;
  • Google (Gemini) — image generation and video/content analysis;
  • fal.ai — video generation;
  • ElevenLabs — text-to-speech / voiceover;
  • Higgsfield — image generation;
  • Foreplay — advertising research data.

When you use related features, your Inputs and User Content are transmitted to and processed by these Providers under their own terms and privacy policies, over which we have no control. We encourage you to review their policies. The specific Providers may change over time.

6.How We Disclose Information

  • Providers and sub-processors: as described in Section 5, to deliver the Service.
  • Legal and safety: to comply with law, legal process, or governmental request; to enforce our Terms; or to protect the rights, property, or safety of Motiontelligent, our users, or others.
  • Business transfers: in connection with a merger, acquisition, financing, reorganization, or sale of assets, in which case information may be transferred as a business asset.
  • With your direction or consent: when you ask us to share information or otherwise consent.

We do not sell your personal information for money. We do not knowingly "sell" or "share" personal information for cross-context behavioral advertising as those terms are defined under California law.

7.Data Retention & Deletion

Locally stored data persists in your browser until you delete it or clear your browser storage. Synchronized media and state stored on our infrastructure are retained until you delete them or request deletion, subject to reasonable backup, log, and legal-retention periods. De-identified and aggregated data may be retained indefinitely. To request deletion of server-stored data associated with your profile, contact us at privacy@motiontelligent.com.

8.Security

We use reasonable technical and organizational measures designed to protect information, including access controls and an authentication gate. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for safeguarding your credentials and sync codes and for the security of your own devices.

9.International Data Transfers

We and our Providers may process and store information in the United States and other countries that may have data-protection laws different from those in your jurisdiction. Where required, we rely on appropriate safeguards (such as Standard Contractual Clauses) for cross-border transfers. By using the Service, you understand that your information may be transferred to and processed in these locations.

10.Your Privacy Rights

EEA/UK (GDPR)

Subject to applicable law, you may have the right to access, correct, delete, restrict, or object to processing of your personal data, to data portability, and to withdraw consent. You may also lodge a complaint with your supervisory authority.

California (CCPA/CPRA)

Subject to applicable law, California residents may have the right to know, access, delete, and correct personal information, and to opt out of "sale" or "sharing" (which we do not engage in as defined). We will not discriminate against you for exercising these rights.

To exercise any rights, contact us at privacy@motiontelligent.com. We may need to verify your identity before responding. You may use an authorized agent where permitted by law.

11.Children's Privacy

The Service is not directed to, and is not intended for use by, individuals under 18 years of age (or under 16 where applicable), and we do not knowingly collect personal information from them. If you believe a minor has provided us personal information, contact us and we will take appropriate steps to delete it.

12.Cookies & Do-Not-Track

We use a strictly necessary first-party authentication cookie and browser storage to operate the Service. Because there is no industry consensus on Do-Not-Track signals, we do not currently respond to them. You can control cookies and clear local storage through your browser settings, but doing so may impair the Service.

13.Changes to This Policy

We may update this Policy from time to time by posting the revised version and updating the "Last updated" date. Material changes may be communicated by reasonable means. Your continued use of the Service after changes take effect constitutes acceptance.
